Terms and Conditions

Welcome to One2Rent.

These Terms and Conditions govern access to and use of the One2Rent platform, establishing the rights, duties and responsibilities of users and of the platform.

By creating an account or using any feature of One2Rent, the user declares that they have read, understood and accepted these Terms and Conditions.

If you do not agree with them, you should refrain from using the platform.

One2Rent is a technology platform intended to support the management of leases and the administration of real estate assets.

The platform provides organisation tools, document management, communication between parties and support for the administration of assets and the respective contractual relationships, without replacing specialised legal, tax, accounting, financial or technical advice.

One2Rent may introduce new features, change existing services or discontinue features, seeking to inform users whenever such changes have a relevant impact on the use of the platform.

For the purposes of these Terms, the following definitions apply:

Platform – the web application, mobile application, website and other services made available under the One2Rent brand.

User – any natural or legal person who uses the platform.

Landlord – a user who manages one or more real estate assets.

Tenant – a user who is the lessee of one or more real estate assets managed by a landlord through the platform.

Administrator – a user authorised to manage and administer the platform.

Account – the set of credentials that allows access to the platform.

Content – all information, documents, images, photographs and other elements uploaded by users.

Services – the set of features made available by One2Rent.

Use of the platform presupposes that the user has legal capacity to enter into contracts under the applicable legislation.

By creating an account, the user declares that the information provided is true, complete and up to date.

Each user is responsible for the confidentiality of their respective access credentials.

The user undertakes to:

• keep their data up to date;
• use a secure password;
• not share their account with third parties;
• immediately report any unauthorised use of their account.

One2Rent may adopt additional authentication and security mechanisms whenever it considers this necessary.

The user undertakes to use the platform diligently, responsibly and in accordance with the applicable legislation.

In particular, the user undertakes not to:

• use the platform for unlawful purposes;
• enter false or misleading information;
• upload content that infringes third-party rights;
• attempt to compromise the security or operation of the platform;
• use automated mechanisms that harm the normal functioning of the services;
• engage in any act likely to cause damage to One2Rent or to other users.

The platform allows the entry of data relating to third parties, namely landlords, tenants, guarantors, legal representatives or other parties involved.

The user who enters such data declares that they have legitimacy to do so and assumes responsibility for its accuracy, updating and compliance with the applicable legislation.

The documents, photographs and other content uploaded to the platform remain the property of their respective holders or of whoever lawfully holds the respective rights.

By using the platform, the user grants One2Rent only the authorisations strictly necessary to store, process and make available such content within the scope of the contracted features.

One2Rent does not claim any ownership right over content uploaded by users.

The platform may make available features based on Artificial Intelligence, automation or other supporting technologies.

These features are intended solely to assist users in managing leases and administering real estate assets.

The results produced constitute decision-support and must be reviewed by the user before use.

One2Rent does not guarantee that the results produced by these features are free of errors or suitable for all specific situations.

The platform may integrate or make available services provided by third-party entities, including, among others:

• payment systems;
• electronic signature;
• document storage;
• Artificial Intelligence services;
• sending of notifications;
• marketplace of service providers;
• other technological integrations.

Each third-party entity is responsible for the services it provides, under its respective terms of use.

One2Rent may make available different usage plans, free or paid.

The features available may vary depending on the contracted plan.

The creation, alteration or discontinuation of commercial plans shall not affect rights legally acquired by users.

One2Rent will seek to ensure high levels of platform availability.

However, temporary interruptions may occur as a result of:

• maintenance operations;
• updates;
• technical incidents;
• communications failures;
• events beyond One2Rent's reasonable control.

Whenever possible, such interventions will be carried out so as to minimise the impact on the use of the platform.

One2Rent is under continuous development.

New features, improvements, interface changes or technical modifications intended to improve the user experience, security or performance of the platform may be introduced.

One2Rent is a management support platform.

The information made available through the platform does not replace specialised legal, tax, accounting, financial, technical or other professional advice.

It is the user's responsibility to validate all relevant information before making decisions.

To the maximum extent permitted by law, One2Rent may not be held liable for damages resulting from:

• improper use of the platform;
• incorrect information entered by users;
• decisions taken exclusively on the basis of automatic features;
• temporary unavailability of the services;
• actions of third-party entities.

Nothing in these Terms excludes or limits liability that cannot be legally excluded.

All intellectual property rights relating to the One2Rent platform, including software, design, graphic interface, logos, trademarks, texts, graphic elements and other proprietary content, belong to One2Rent or to their respective holders.

Use of the platform does not confer on the user any right over such elements, beyond what is necessary for normal use of the services.

One2Rent may suspend or close user accounts whenever there are well-founded indications of:

• fraudulent use;
• breach of these Terms;
• unlawful use of the platform;
• conduct likely to compromise the security or normal functioning of the services.

Whenever possible, the user will be informed in advance, unless legal, security or urgency reasons advise against this.

The user may request the closure of their account through the contact indicated in the Privacy Policy. During the controlled Beta phase, the request will be processed manually, and certain data may be retained where necessary to comply with legal or contractual obligations.

These Terms may be amended to reflect legal, technical or functional changes to the platform.

Whenever changes are materially relevant, users will be informed through the means considered appropriate.

Continued use of the platform after the amendments come into force constitutes acceptance of the new Terms, without prejudice to the rights legally recognised to users.

These Terms are governed by Portuguese law.

Without prejudice to the alternative dispute resolution mechanisms legally provided for, the Portuguese courts shall have jurisdiction to settle any disputes arising from the use of the platform, in accordance with the applicable legislation.
